В презентации кратко приведены некоторые методологические подходы, в том числе в Китае и Германии, к установлению содержания иностранного права в судебных разбирательствах. Презентация основывается на практическом опыте автора по подготовке юридических заключений, в том числе, по российскому праву, для судебных процессов и арбитражей в различных юрисдикциях.

Изложены некоторые рекомендации лицам, выступающим в качестве экспертов по иностранному праву в судах. 

В презентации также имеются полезные ссылки для дальнейшего изучения темы.

The presentation briefly presents certain methodological approaches, including those in China and Germany, to establishing the content of foreign law in litigation by experts.

It summarizes the author’s practical experience in drafting legal opinions and expert reports, including on Russian law, for litigation and arbitration in various jurisdictions.

The presentation outlines some recommendations for persons acting as experts on foreign law in courts.

It also contains useful links for further study of the topic.

 

About the Author:

Dr Davydenko directs and co-edis the CIS Arbitration Forum. He is a lawyer with 20+ years experience in Russian and transnational law. He teaches law at Belarusian State University, Department of International law, MGIMO (Tashkent), and other law schools in France, Russia and other jurisdictions. Dmitry Davydenko has experience as an arbitrator in the ICC and other arbitral proceedings and is listed as a recommended arbitrator of DIAC, HKIAC, TIAC as well as of other reputed arbitral institutions. Included in the list of best practitioners in arbitration in Russia as of the years 2017 through 2021 (a Global leader for 2022) by Who’s Who Legal and Global Arbitration Review (GAR). He also acts as a Russian law expert on various matters related to international commerce.
